Respected Sir,

 

We lodge this present complaint on behalf of the victim Mr. Dulal Sarkar and others from District-Murshidabad, West Bengal. The perpetrator police personnel of Berhampore and Jalangi Police Station arrested the victims from their respective houses without disclosing any reasons for the arrest and no Memo of Arrest was issued at the time of arrest. At the time of arrest the victims were brutally assaulted and their houses were ransacked by the perpetrator police personnel. Later the victims were shown as arrestee in connection with one criminal case upon manufacturing false records.

 

In this incident the perpetrator police personnel became the violator of law by not complying with the guidelines issued by the Apex Court in DK Basu judgment and also there has been violation of Sections 50, 50-A, 55-A, 57 and 60-A of Criminal Procedure Code. 

 

Hence we seek your urgent intervention in this case in the following manner:-

 

·         The whole matter must be investigated by a neutral investigating agency appointed by the Commission

·         The perpetrator police personnel must be booked immediately under the law and punished accordingly

·         The victims must be relieved immediately from all false and concocted allegations.

·         The victims must be given adequate protection and compensation.

Particulars of the victims: - (1) Mr. Dulal Sarkar, son of Mr. Bhaduri Sarkar; (2) Mr. Prafulla Sarkar, son of Bhasaram Sarkar and (3) Mr. Kalipada Durani, son of Late Balaram Durani, all are belonging to Scheduled Caste community and all of village- Udaynagar Colony, Police Station-Jalangi, District-Murshidabad. 

 

Particulars of the perpetrators: - About 9 police personnel including Mr. Bahar Ali Sub-Inspector of Police Berhampore Police Station and Mr. Shyamaprosad Saha being the Officer-in-Charge and Mr. Kajisaheb being the Second Officer of Jalangi Police Station

 

Place of the incident: - in the houses of the victims in village- Udaynagar Colony, Police Station-Jalangi, District-Murshidabad. 

 

Date & time of the incident: - On 11.1.2012 at about 11 pm

 

Fact Finding Details:-

 

It is revealed during the fact finding that on 11.1.2012 at about 11 pm about 9 police personnel including Mr. Bahar Ali Sub-Inspector of Police Berhampore Police Station and Mr. Shyamaprosad Saha being the Officer-in-Charge and Mr. Kajisaheb being the Second Officer of Jalangi Police Station forcibly entered into the house of the victim by breaking open the door of the house. The police personnel captured Mr. Dulal Sarkar and started assaulting him. He was being tied by one rope and the police personnel dragged him forcibly. Ms. Parbati Sarkar, wife of Dulal Sarkar tried to save him from the hands of the police personnel but the police personnel abused her and assaulted her by wooden stick, fists and blows in absence of any female police person. The police personnel also broke the household articles in the house. Then the police personnel moved to the house of Mr. Prafulla Sarkar, son of Bhasaram Sarkar and Mr. Kalipada Durani, son of Late Balaram Durani and assaulted them brutally. The police personnel also in similar manner broke the house articles in the houses of Mr. Prafulla Sarkar and Mr. Kalipada Durani. Then the police personnel brought Mr. Dulal Sarkar, Mr. Prafulla Sarkar and Mr. Kalipada Durani at Berhampore Police Station and later produced them before the concerned magistrate by implicating them in a criminal case vide Berhampore Police Station Case no. 1351/2011 dated 23.11.2011 under sections 399/402 of Indian Penal Code and also under sections 25/28 of Arms Act. The police did not disclose any reason for the arrest of the victims. It is further revealed that the police also manufacture records showing different place and time of arrest of the victims in order to suppress their misdeeds.

 

Mr. Govinda Sarkar, the elder brother of the victim, lodged one written compliant before the Superintendent of Police, Murshidabad regarding the incident of police torture upon the victims as stated above. But till date there has been neither any enquiry nor any action taken by the Superintendent of Police, Murshidabad over the complaint. Ms. Parbati Sarkar, wife of Dulal Sarkar suffered injuries as a result of the assault committed upon her by the perpetrator police personnel and she was medically treated.

 

It is also revealed during the fact finding that the victims come from poor financial background and they are basically daily wage earners. It is reported that that the victims were falsely implicated in the criminal case out of political vendetta.
