Respected Sir,

We want to draw your kind attention to the following facts and lodge this
complaint that the victim Mr. Abdul Rouf Mondal, son of late Latif Mondal
of village-Ramchandrapur, Police Station-Baduria, District-North 24
Parganas, West Bengal is an activist against carrying of illegal brick
fields in the area where he resides. He raised his voice against the
dishonest persons involved in carrying such illegal brick fields without
any care of law without any care of environment and cutting river
embankments abruptly and some dishonest government employees were also
involved in such illegal acts for money.

As a result the persons involved in such illegal carrying of brick fields
made a conspiracy to stop his protesting voice with the help of police.
According to the victim's family that as a result of such conspiracy he was
arrested on 15.2.2011 at about 8.30 am from Ramchandrapur Bazar area in
front of hundreds of public without showing any papers or reasons. The
perpetrator police personnel took him to Baduria Police Station and after
few hours the police of Baduria Police Station handed him over to Deganga
Police Station. The victim was tortured in the police lock up by the police
personnel of Deganga Police Station in some barbaric manner and at the same
time the perpetrator police personnel advised him not to act against the
brick fields in future. The involved police personnel tortured him by tying
his male organ with a rope and hanged a heavy weight iron article from the
other end of the rope, as a result he was bleeding from his male organ and
the perpetrator police personnel also tortured him by gripping his toes
with an iron gripper (*Sarashi* in Bangla language).

On 16.2.2011 the police of Deganga Police Station produced him before the
Additional District & Sessions Judge, 6th Court, Barasat, North 24 Parganas
in connection with a criminal case vide Deganga Police Station Case no.
96/2011 dated 16.2.2011 under section 20(b) (i) of NDPS Act. The police
implicated him in the said case by alleging against him of illegally
possessing 4 Kilograms of 'Ganja'. The police in its records showed that he
was arrested at 22.05 hours on 15.2.2011 from Berachampa Rupchaya Cinema
Hall which according to the victim and his family members is absolutely
false.

The fact remains that the *victim already lodged a complaint before the
Commission on 18.11.2011 and the complaint was treated as Case no.
1344/25/15/2011/OC/M-4*. The Commission transferred the said complaint for
disposal to the West Bengal Human Rights Commission for disposal. But till
date no fruitful result came out to the victim and his grievances are still
to be adjudicated.

The victim is now serving in jail as an Under Trial Prisoner (UTP). The
victim's wife Ms. Rupiya Bibi met him in jail and came to know from him
that he is deprived of food, treatment and other basic facilities in the
jail. The victim is yet to be recovered from physical frailty which was
caused due to the police torture in custody, but the jail authority
completely ignored to provide him proper treatment till date. The victim's
wife complained before the jail authority in this regard, but the jail
authority did not pay any heed. As a result the condition of the victim is
deteriorating day by day.

The victim is a Human Rights Defender and he was subjected to police
torture and put behind the bar by bringing false and fabricated charge
against him for his activism against the carrying of illegal brick fields.

Hence we seek your urgent intervention in this matter in the following
manner:-

- The whole matter must be investigated by one neutral investigating
agency appointed by the Commission focusing specially focusing on the point
that the victim being a Human Rights Defender has been subjected to torture
and implicated in false charges.
- The jail authority must be directed to immediately arrange for proper
medical treatment of the victim and give him basic facilities according to
law and rules.
- We demand that the perpetrator police personnel of Baduria Police
Station and Deganga Police Station must be booked immediately under the law
for their heinous acts of subjecting the victim to torture in most inhuman
manner in their custody and they must be punished accordingly. Moreover if
any enquiry is pending against the perpetrator police personnel then it
must be neutrally be enquired into and the process of enquiry must not be
delayed for indefinite period.
- The victim must be relieved from all false and fabricated charges
immediately.
- As West Bengal Human Rights Commission is defunct with all practical
purposes, please withdraw the case from their jurisdiction and take
immediate action from your end.
