Here I want to draw your kind attention toward an incident of trafficking of a minor girl to Bangladesh with false promise of marriage, her illegal confinement by one Bangladeshi kingpin for immoral purposes. The father of the victim girl residing at bordering village made complaint to the Gaighata police station with specific allegation of kidnapping and forceful confinement of a minor for immoral purposes. But shamefully the police not paid appropriate attention to the incident and by entering a general dairy entry shirked off their duty. As in recent time the Honorable High Court of Calcutta opined and expressed their concern over the increasing cross border trafficking and directed law enforcement agency to produce the victim before the court within a stipulated time, the indifference shown by the Gaighata police is an injudicious act on their part.

 

In this context, I am attaching a thorough fact finding report and age certificate of the victim girl and making following demands to your Commission and other respective institutions and authorities:-

 

  1. The incident should be investigated by the special anti- trafficking cell of Criminal Investigation Department.
  2. Immediate actions should be taken for rescue and repatriation of the victim girl.
  3. The perpetrators should be immediately booked under Immoral Trafficking Prevention Act. The law enforcing agencies should be encouraged to use this relevant Act in case of trafficking.
  4. The callous police officials should be brought under scanner for their irresponsible non- action.
  5. A joint mechanism should be formulated and derived between governments of India and Bangladesh to minimize the incidents of cross border trafficking of women and girl

Case Detail

 

Victim's name and address- Sarswati Kabiraj (name changed), aged about 15 years, Daughter of Mr. Swapan Kabiraj of village- Chotto Sehana, Post Office- Angrail, Police Station- Gaighata, District- 24 Parganas (North)

 

Name of the perpetrators- 1. Pikul Mondal, son of Mr. Karim Mondal & Nasir Mastan of village- Putkhali, Post Office- Benapol, Police Station- Benapol of Jassore District of Bangladesh 2. On duty Police Officials of Gaighata Police Station

 

Date and time of the incident- 24.10.11

 

On fateful day the victim girl met Pikul Mondal on her way to school. Pikul Mondal, an alleged cross border smuggler used to visit Indian side very often. In this course the duo got involved with each other. The said perpetrator eloped with the girl by making false promise of marriage. Pikul forcefully brought the girl to Bangladesh and sold the girl to one Nasir Mastan of same address and the Nasir forcibly confined her for illegal sex trade. Nasir Mastan is a known kingpin of trafficking and illegal sex trade in the border area. The father of the victim girl; Mr. Swapan Kabiraj went to Gaighata police station on 24.10.11 and made a written complaint about kidnapping and trafficking of his daughter by Pikul Mondal, the on duty police personnel overlooked the issue for reasons best known to them and made a general dairy entry vide GDE no. 1338 dated 24.10.11 instead of First Information Report. Till date no adequate actions have been taken for rescue and repatriation of the girl. The villagers and father of the victim girl met Mr. Birendra Nath Mondal a sitting member of Duma Gram Panchayet and informed him about the incident and asked for his help but till date no action has been taken by the panchayet. The father also provided relevant Indian phone numbers of the perpetrator and Nasir Mastan to the police for further inquiry and recourse measures. He also alleged that the Bangladeshi traffickers are using Indian sim card and Indian numbers by exploiting their Indian contacts. Pikul has Indian connection vide number 9333040716 and Nasir with 9333618391.
