Eligibility Criteria for Admission in Nursery Class in Deaf School in Admission Notice appeared in Delhi Newspapers May 13, 2011 Violates RTE Act Social Jurist, A Civil Rights Group To Hon'ble Chief Minister of Delhi, Delhi Secretariat, I.P.Estate, New Delhi-110002 14.05.2011 Sub: Eligibility Criteria for Admission in Nursery Class in Deaf School in Admission Notice appeared in Delhi Newspapers dated May 13, 2011 Violates RTE Act, 2009 Respected Madam, It is brought to your notice that there are eight eligibility conditions in the Admission Notice Advertised in Delhi Newspapers dated May 13, 2011 for admission in Nursery Class in Deaf School run by Social Welfare Department of Govt of NCT of Delhi at Sector 4, Rohini, Delhi and all the eight violate in one way or another the provisions of Right of Children to Free and Compulsory Education Act, 2009 (RTE Act, 2009). A copy of the said advertisement is enclosed hereto for your ready reference. 1. Resident of Delhi - a child is a child, and as along as the child is presented in the school, he/ she is to be admitted. 2. Age - not at all a criteria for admission. 3. Birth certificate- and that also from NDMC/MCD only (they really want to make sure that children from other places do not come. The birth certificate of my child says Indore- and even though I live in Delhi and the child lives in Delhi, she becomes ineligible - of course they are wrong in asking for any kind of birth certificate.) 4. Hearing impaired certificate - question is why has the school not heard of the RTE Act, PWD Act, National Trust Act etc. and the fact that all children need to be included? And why are they running a special school for the deaf? 5. Mentally fit! - IQ test.! Who does all this in day and age? It is wrong and violative of the right of every child to be in a school, and they are not ashamed of asking for it. The IQ test result that the Department is demanding is an absolute insult of the provisions of RTE Act, 2009 since they are demanding that child should be mentally fit. 6. Raton card! All the hurdles are there to ensure that only the very serious get in. 7. Application dates and time - The ad is coming on 13th May and the last date is 31st May. Although the ad says forms will be available from 1st April 8. School phone will give further information - what if the parents are also deaf? They need a website and they should be free to come personally. It is submitted that the advertisement by the Social Welfare Department is a symptom of the fragmentation of policy with education of children with disabilities between Ministry of Social Justice & Empowerment rather than Ministry of Human Resource Development. The fact that the RTE Act has been notified a year ago, has had absolutely no effect on impacting the Social Welfare Department which does not run special schools under the norms prescribed by the Model Rules and the RTE Act norms. You are therefore requested to forthwith withdraw the said Admission Notice. You are also requested to convert the said Deaf School into a Mainstreamed Inclusive School where all the children including children with disabilities can be admitted and study.
