Government to bring in new land acquisition law: Chidambaram

New Delhi: The government was all set to bring in a new land acquisition law for better compensation and rehabilitation to farmers, Home Minister P. Chidambaram said Thursday as unrest on the issue continued in parts of Uttar Pradesh.

The new legislation, he said, would be introduced in parliament in the next session likely in July. He did "not rule out" the possibility of an ordinance laying out the new land acquisition rules till then.

Chidambaram said the government had earlier drafted the law but failed to build political consensus on the issue, which is why the bill could not be tabled in parliament.

"We must have a new land acquisition act. Consensus building has taken some time," the home minister told reporters after the meeting of the newly constituted Group of Ministers (GoM) to communicate the government's policies and decisions to the public through the media.

Chidambaram heads the panel that includes union ministers Ambika Soni, Ghulam Nabi Azad, Kapil Sibal, Salman Khursheed, Pawan Bansal and V. Narayanasamy.

The home minister said the government had made some amendments to the land acquisition draft bill. "I can say with a fair degree of certainty that there is consensus now. It is the government's intention to introduce that law in the next session."

He said the law and order situation in Uttar Pradesh "is not a very happy situation". His comments came as clashes between police and farmers led by political activists continued Thursday, a day after Congress leader Rahul Gandhi was arrested and then released for staging a sit-in in support of the farmers.

"Many villagers, farmers are protesting on the issue of acquisition of land and compensation. Political parties are espousing the cause of farmers and some lives have been lost, that is distressing," Chidambaram said.

Violence on the issue of farmers demanding higher compensation for their land led to escalated clashes in Greater Noida area leading to four people being killed - three on Saturday and one on Sunday.

She said the clashes in Bhatta Parsaul in Greater Noida had nothing to do with the issue of land compensation.

"By spreading lies and rumours, opposition parties are attempting to disturb law and order situation by misleading people and Bhatta Parsaul incident is an example of their dirty politics," Mayawati told reporters here.

She accused Congress leader Rahul Gandhi, who staged a dharna in Bhatta yesterday before being detained and released, of indulging in "mean dramatics".

Mayawati said that whatever Rahul Gandhi has to do on the issue of acquisition of farmers' land, he should first do in his party.

"I would like to tell 'Yuvraj' that whatever struggle he has to do, he should do in his home first, as the decision is in the hands of the Centre.

"It seems that he is not being heard in his own home and he is venting his frustration by indulging in mean dramatics," she alleged.

Mayawati said that from time to time the cabinet secretary has on her behalf clarified the situation, but still an attempt was being made to mislead people by associating the issue with land compensation.

"As a part of the conspiracy rumours are being spread that the land has been given for Yaumna and Ganga expressways, which is completely false," she said.

She said the land was taken for development under masterplan of the Greater Noida Authority."I strongly condemn false publicity despite repeated clarification," she said.
Mayawati said that farmers in Gautam Buddha Nagar gave their land to Greater Noida authority way back in 2009 and had taken the compensation.

"From this it is clear that the incident had nothing to with the compensation. This is dity politics of the opposition parties," she alleged. 

Rajnath Singh backs farmers, sits on daylong fast

Senior Bharatiya Janata Party (BJP) leader Rajnath Singh Thursday went on a daylong hunger strike in Ghaziabad in support of protesting farmers in Greater Noida and to draw attention to the "deteriorating law and order situation in Uttar Pradesh".

Rajnath Singh, who was arrested Monday while proceeding to Bhatta-Parsaul village - the epicentre of the farmers' agitation demanding higher compensation for their land acquired by the government - said he was protesting in Ghaziabad -- his Lok Sabha constituency, as prohibitory orders were in force in Greater Noida.

Rajya Sabha Leader of Opposition Arun Jaitley, Janata Dal-United general secretary K.C. Tyagi, BJP vice president Muktar Abbas Ansari and several other National Democratic Alliance (NDA) leaders held a meeting, which marked the beginning of the fast.

Rajnath Singh, who is also the former chief minister of Uttar Pradesh, said the law and order situation in the state under Chief Minister Mayawati had "deteriorated to the lowest levels".

Quoting from the national crime record statistics, Rajnath Singh said the situation in Uttar Pradesh was "worse than Jammu and Kashmir which is considered to be the epicentre of terrorism in the country".

He said the BJP would continue its agitation in support of the farmers in Greater Noida and other parts of the state.

He described the sit-in of Congress general secretary Rahul Gandhi in support of farmers in Bhatta-Parsaul Wednesday as a "drama".

"Why should Rahul sit on dharna? He has the central government in Delhi. Why doesn't he take up the issue there?" he asked.

Clashes had broken out between farmers and security forces Saturday, resulting in the deaths of four people, including one on Sunday.

Agra, May 12 (PTI) BJP MP Varun Gandhi today said no politics should be seen into Congress leader Rahul Gandhi''s support to farmers'' agitation.
"No politics should be seen into Rahul''s dharna at Parsaul village. This is a fight of farmers and all politicians -- barring BSP -- cutting across party lines, including BJP leaders Rajnath Singh and Kalraj Mishra have extended their support to the farmers'' cause," he told reporters here.
Slamming the Mayawati government for police firing on farmers, Varun said the days of BSP government in UP were numbered.



As a controversy rages over land acquisition in Uttar Pradesh, the Centre today said it has plans to introduce a bill in this regard in the next session of Parliament as there appears to be consensus on the issue. On the other hand,The Finance Ministry will take up 42 foreign direct investment (FDI) proposals, including that of BNP Paribas , Tata Steel and PTC India Financial Services, next week. India on Thursday ratified United Nations Convention Against Corruption which will help it deal with the problem of black-money and corruption through legislative and administrative measures.The Convention, ratified six years after it was signed by India, will help the government to seize illicit money and assets, Indian government officials said.The Supreme Court on Thursday pulled up the Enforcement Directorate for keeping it in dark about filing of charge sheet against Pune-based stud farm owner Hasan Ali Khan in a case of alleged money laundering and questioned the functioning of a high-level committee(HLC) formed by the government to monitor probe in black money cases.

The Convention has already been inked by 140 countries.

In the backdrop of agitation by Anna Hazare-led civil society activists, questions had been raised recently on why India was not ratifying the convention even six years after signing it.

And see, Taking strong exception, the apex court, which has been monitoring the probe in blackmoney cases, sought an explanation on why the ED did not inform it about filing of charge sheet which was done just two days before it had heard the case.

"Why is it that we were not informed that investigation is complete against that man (Hasan Ali). In your status report you had said that investigation was still going on. But two days after we read it in newspapers that you have filed the charge sheet. We must express our reservation on it," a bench comprising justices B. Sudershan Reddy and S.S. Nijjar said.

In the last hearing on May 4, the ED had placed its status report on the investigation in the black money case involving Khan and others but it did not make a mention of the charge sheet to be filed on May 6 before a special court in Mumbai.

The bench also expressed surprised on why charge sheet was not placed before the HLC which was appointed by the government to counter the plea of setting up of SIT to monitor the probe and steps taken by various agencies to bring back money stashed in foreign banks.

"We thought that someone(retired SC judge) should monitor all such cases but you put in place mechanism to monitor such cases. We want to see where lies your mechanism and how it has been doing," the bench said while questioning the Centre whether the committee went through the charge sheet.

"You (ED) filed the charge sheet without placing it before the committee you have constituted and we are surprised," the bench said.

Solicitor General Gopal Subramanium, who had vehemently opposed the setting up of SIT, consulted with the Home Ministry officials and replied "No".

"We are surprised to know. You yourself put in the mechanism. Why was the charge sheet not placed before the committee?" the bench asked.

Mr. Subramanium replied, "I have no idea".

He agreed that the charge sheet should have been placed before the committee and said corrective measures will be ensured.

"India has completed the process of ratification of U.N. Convention Against Corruption," an official said.

According to the U.N. Convention, each member country shall "consider adopting appropriate legislative and administrative measures, consistent with the objectives of this Convention and in accordance with the fundamental principles of its domestic law, to prescribe criteria concerning candidature for and election to public office."

It also prescribes disciplinary or other measures against public officials who violate the codes or standards established in accordance with this article.

"The ratification of the Convention is reaffirmation of our government's commitment to fight corruption and to undertake vigorously administrative and legal reforms to enable our law enforcement agencies to recover illicit assets stolen by corrupt practices," the official said.

The completion of the ratification process has been under active consideration of the Indian government since September last year, the official said.

A Group of Ministers has been overseeing the ratification process.

Before ratifying the UN Convention, government was required to make changes in domestic laws to have more transparency in funding election campaigns and political parties among other crucial legislative steps to bring it at par with the international instrument.

However, Home Minister P Chidambaram said law and order in Uttar Pradesh is not a "happy situation" as farmers were protesting in many villages on the land acquisition issue and criticised the way Chief Minister Mayawati was handling the protests by farmers. But he ruled out sending a central team to assess the situation there in view of recent clashes in Bhatta Parsaul in Greater Noida where two farmers and as many policemen were killed.

The Foreign Investment Promotion Board (FIPB) headed by Economic Affairs Secretary R Gopalan is scheduled to meet on May 20 here.

As per the Finance Ministry, 15 proposals are new ones and 14 are those on which decisions were deferred in the previous FIPB meetings.

Besides, 11 companies after amending their earlier requests are seeking the FIPB's nod for bringing in FDI. They include Tata Steel and Star News Broadcasting (Touch Tele Content (I) Ltd).

Some of the deferred proposals which are on the agenda include those of Park Controls and Communications, Bangalore; NCBG Holdings, Inc, Cayman Islands and Mango Holding, Bangladesh.

In its last meeting, FIPB had cleared 21 FDI proposals amounting to Rs 1,027 crore. In all it had taken up 47 proposals but deferred decisions on 17 applications while rejecting nine.

FDI inflows into the country during April-February, 2010-11, dipped by 29 per cent to Rs 83,687 from Rs 1,17,622 crore in the corresponding period of the previous fiscal.

"We must have a new land acquisition law. Government has drafted a new act that has provisions for better compensation, rehabilitation and other measures. But it was not possible to build a consensus on the law.

"Consensus building took some time. Now we are at a point when there is a fair degree of certainty that there is a consensus on the law with some amendments," he told a press conference, the first after Prime Minister Manmohan Singh formed a Group of Ministers to brief media to counter the bad press government may face on occasions.

He said it is the government's intention to introduce a bill in the next session of Parliament and did not rule out bringing an ordinance in this regard.

On the midnight drama over the arrest and release of Rahul Gandhi, who spent a day in Bhatta Parsaul yesterday, Union Minority Affairs Minister Salman Khurshid attacked Mayawati over the way his protest was handled by the government and police.

"Very clearly whatever he (Rahul) did was entirely right because as a Member of Parliament from Uttar Pradesh and as a leader, he has every right to be there. He just wanted to spend the night there.

"There was no need to interfere with it. As an MP from Uttar Pradesh he has every right to express his concerns for the farmers and now it is more than evident that the people of Uttar Pradesh is extremely unhappy over the manner in which the matter is being dealt with," he said.

Khurshid said Mayawati is "jittery and losing sleep" over the tremendous support and respect Rahul Gandhi was getting both inside and outside party.

Chidambaram expressed the hope that the Uttar Pradesh government will heed to reason and respond to the "just demands" of the people.
